Generally, a sentencing court may not impose a more severe sentence than one bargained for without providing the defendant the opportunity to withdraw his or her plea. see People v Brown, 198 AD2d 901 (1993). This is the general rule. All cases are different. This is not legal advice for your specific case. An attorney would have to review your case in detail including all documents and also interview you. If you would like to speak further please feel free to call me.
