Re: possesion of a gun

It depends on whether or not the person charged has any prior felony convictions. The current law is that criminal possession of a weapon is a class C felony, For adults the minimum penalty is 3 1/2 years up to 15 years in prison. If the crime occurred before the new sentencing guidelines came into effect then the old sentencing range would come in to play. Please feel free to contact my office if you would like to discuss this issue further.

It depends upon the prior criminal record, but with a clean record the time is 3 and1/2years minimum. There may be suppression issues which may result in the charges being dropped due to an illegal search. Only with a complete knowlege of all the facts and circumstances can that be determined.
