possession of controlled substaince

my son was arrested of possession of controlled substance. he was driving and the 2 pasangers gotinto a fight theey both got out (girlandboy)fighting a passerby called police with car descibtion when police came the search car and people my son have 7 pills in his pocket. he thinks they were antidepressants . cops doing test to see what they are. bail was set at 100.00 cop told him it was a misderminor we arenot sure. he aslo has a dwai in march 2006 in finished all requirements for that in july. will that have any bearing on case. what reprocutions are we looking at thank you for any help you can give

It sounds like your son was charged with criminal possession of a controlled substance in the 7th degree, a Class A misdemeanor. Whenever a car is involved there are always issues concerning the search of the car and the occupants. Search and seizure laws are implicated, and there a number of defenses available to your son.
