Legal Question in Criminal Law in New York
possession of forgery or attempted forgery
a company claims they found former employees employment history in my sister area. a photo copy of the former employees drivers lic had a photo copy of her driver lic picture taped over it as if it was going to be copied off. the police said they found it in her area, but her area is open she has no keys to any lockers or drawers to her knowledge, she doesn't even have a place to lock up her purse. Anyone could have gotten her driver lic made a photo copy and placed it back in her purse without her knowledge. The police spoke to her about the issue, she said she didn't do it, and had no idea how a photo copy of her picture driver lic, got on former employees photo copy driver lic. The police said they could charge her with possession of a forged instrument. It looked to them like idenity theif. She was not arrested. The other big problem is she is on parole. They found nothing on her or in her car or purse. When she say the documentation the police say the found in her area, the police was bringing in the building on their steel pad. Any and everyone in the company has access to her area and her purse. Both documentations used hers and the former employees were photo copies.

Re: possession of forgery or attempted forgery
This has not yet become a problem for your sister. Unless/until the police charge her with a crime the problem remains speculative and does not impose consequences. It is an open question whether or not she should report this as a potential problem to her parole officer. If it were me, I would report it. But the decision is your sister's.
