Legal Question in Criminal Law in New York

Hello, my brother received 13 years flat for manslaughter but the judge forgot to impose the 5 yrs post release. The docs dept imposed it and my brother is up for re sentencing. By law can they add the 5 yrs to his 13 making 18 or will the 5 years be accommodated into the 13? He has already completed 8 yrs.

There are many new cases where post release wasn't properly added
At the time of sentencing and its usually resulted in the post
Release being dropped.
If he was sentenced to a thirteen flat he should only do 130 months
And like I mentioned no post release.
