Legal Question in Criminal Law in New York

probation restrictions

I am getting married on a cruise ship in october. My best frind and best man is on probation. He was told by his probation officer that coming on the cruise should not be a problem. Now 2 weeks before we are supposed to leave the probation officer says no. Is there any way around this? Should he get his lawyer involved? Is there another step he can take?

Re: probation restrictions

My best wishes for a happy and long marriage.

The other lawyers are right: the judge can decide to over-rule the probation officer.

One more thing, posting a 'bond' (exactly like a bail-bond) will make it 99% likely the judge will grant permission.

Have him make an application to the Judge.

Re: probation restrictions

I agree with Mr. Rothstein. A motion must be made to the judge.
