Legal Question in Criminal Law in New York
Probation Violation
I have a probation violation hearing on June 26, 2002, reasons being; 3 drug tests failed w/ positive results for marijuana, but my count has progressively gone lower since the start of my probation on October 9, 2001, also I have missed several days of my weekly probation visits, I am to report twice a week and I have missed several days, but I have letters from company explaining my responsibilities there and my time schedule, and also a letter from Family Court excusing me from my Tuesday visits which were OK with my Officer until 3 weeks after. Another cause of my violation is that they refered me to a drug program for marijuana, but I was unable to attend due to work, I requested a new date to appear at the program, but my requests were not furnished as I was given an early afternoon appointment on a day that I could not make it, I asked my PO before that date to reschedule, but they are going to use it against me in court. I do have a letter from another program director where she notes that I have been requesting a Drug program on several occasions even before probation ordered it for me. Please contact me at (917) 604-2506, or contact me via e-mail as soon as possible. Thank You.
