Legal Question in Criminal Law in New York
Public defenders
I was accused of a crime i did not commit. I let a person use my computer, they used stolen credit cards to purchase items that came to my home. My daughter and i did not sign for the packages on several occasions.A ''mailman'' quoted my name i said yes he had packages for my roomate. I did not sign for these packages. Next thing, the ''ups delivery'' man was asking me to sign for packages i did not order nor my roomate. When i declined to sign,my home was invaded by 20 officers with a search warrant. Now i am going back and forth to court for a crime i did not commit. The public defender said she would investigate to see if i signed any packages. She did not. She said i was going to jail, i was guilty, i'm nuts, she made me feel that i had no hope at all. The judge said i could not get another lawyer. I feel like my life is over because of a man i've met after my fiance did not come back from iraq. I was used, and my identity was stolen from this person, also, pieces of mail from my daughter and roomate. Can you please give me advice. Also, can i sue the legal aid service for imcompetence also this lawyer? I already complained to her boss, no reply and i am putting that complaint on paper. Help me please.

Re: Public defenders
Your best option would be to hire your own private attorney, the court can not stop you from doing this - they can only stop you from trading legal aid attoreys... You have an absolute right to hire your own attorney at any time.
As far as a law suit against the legal aid society, such a claim would be very difficult to win - usually unless there is a major egrefious error you will not be able to win, and as such following through with such a claim would be close to pointless in most matters.
