Legal Question in Criminal Law in New York
Question
My boyfriend held me captive in my house for 2 hours the other night and choked me, tried to rape me and mentally tortured me. He was arraigned today and he is facing felony charges (assault, unlawful imprisonment, larceny and attempted sexual assault). How much time, if any, is he looking at? I am afriad that he is going to get out and come after me. I am in NYS and there is a restraining order in place, but he is originally from out of state and has no family or friends here...all of his belongings are in our shared apartment. What happens from here?

Re: Question
First, can you move out?? If not, put all of his things in boxes and get them to his lawyers office. If that is impossible put them in storage at a storage company. Change all locks and passwords and alert neighbors to the fact that there has been trouble and they need to be on the look out.
Have a person you check in with everyday, 3 times a day or more. If you do not call at a specific time, that friend should notify the police.
Tell the District Attorney's office you want to be notified if he is released on bail or otherwise.
Install a tape on your phone at home so that you can record his calls and get caller ID.
Notify security at work and be sure you are walked to your car each night and met in the mornings to be brought into the building. Tell reception that you do not want any flowers or any other deliveries at your desk.
Good Luck
