Legal Question in Criminal Law in New York
how r you? we have a problem with our 19 y.o. daughter who has been using pot on a off for 3 years. she stops for about a month when we catch her. we have taken the car away, and she has stopped college because of poor grades. eventhough she is over 18, can we have her mandated to a rehab program by the court without having her arrested?

No-- There would be no penalty because there is no criminal charge. There are however civil options which would necessitate you taking a hard line on room and board and other things you may provide for her.
