Legal Question in Criminal Law in New York

I was randomly stopped at a checkpoint. A officer asked me license and registration and I cooperated with him and gaved him it. So he takes my license to run it and another officer comes to my car and sees a red cup empty on the floor. No Alcohol inside just layin there. I wanted to know what is my best defense for this case.
