Re: rape

He should consult with a criminal defense attorney even if he has not been arrested yet. An attorney can act as a buffer between your friend and law enforcement. While the attorney may not be able to prevent the arrest from happening it can only help your friend if he speaks to an attorney in advance. That being said he should not speak to anyone else about the allegations. If there is an investigation the police may not have enough evidence yet to make an arrest and it would not be in his best interest to make statements to the police or anyone else for that matter, until he has consulted with an attorney and determined the best way to proceed.

Re: rape

The BEST piece of advice that you can give your friend is this . . . SHUT UP!!! Tell him not to speak to anyone about this matter until he has retained an attorney. Set up a consultation with an attorney who handles these types of cases immediately. (Most will provide an initial consultation free of charge)

If you wish to discuss this matter further, feel free to contact my office through my website at McElweeLawOffice.com. I have evening and weekend hours, so provide a phone number and I will contact you or him immediately. Good Luck.
