Legal Question in Criminal Law in New York

Not read my rights

When I was asked to come in to the police station, and after telling my side of the story for why I borrowed money from a non-profit organization, The officer never read my my rights, nor did he tell me I was under arrest. He just told me ''it was sort of an arrest'', and that was it, I was finger printed, picture was taken, and went before a Judge to hear the formal charge against me. 3rd degree grand larceny'' and I told the officer that I was planning on paying the money back, which it was all paid back. $17,642.25..do I have a chance to get my record cleared due to not having my rights read, as I have a felony on my record now, and on probation, starting on my 3rd year.

Re: Not read my rights

rights read, etc is irrelevent. it is good you paid the money back. that was well done.

the best than can be done now is to have the record 'sealed'. that means that no oe will be able to find out. if you are asked on a job application, "have you ever been arrested or convicted of a crime", you can answer "no".

It is done on motion with notice. I can assist you in this matter for a nominal fee.

You are welcome to a consultation at no fee at my offices at 42 west 44th st., NY,NY. Please call for an appointment first. (646) 591-5786
