Legal Question in Criminal Law in New York
i received a upm the other day and need to go to court. i had a cpm 2 years ago that got put to an ACOD, and i stayed clean for the year so it was expunged. my question is will i be eligible for a second ACOD?

Most likely, you will NOT be eligible for a second ACOD. The purpose of an ACOD is to give a defendant an opportunity to have a case dismissed as a first time offender. Therefore, the logic behind it somewhat precludes offering an ACOD to a repeat offender. You should speak with a criminal defense lawyer -- preferably one who handles a lot of marijuana cases.
