Legal Question in Criminal Law in New York

i was recently involved with a grand larceny 4 th case. i was the driver and driver only! i did not steal the property nor make a profit, on the other hand i have a yo felony crim. misch. 3rd degree and have done state time already for this and is now over with how high Are my chances of not going back to prison??

You can be charged with conspiracy and/or aiding and abetting all of which carries prison time.

Grand Larceny in the Fourth Degree is a Class E felony. This means if convicted you can go to prison. Even though you weren�t the one that actually took the stolen property � you were the getaway driver and as such the prosecutor can charge you as an accomplice or acting in concert. The fact that you have a YO shouldn�t be used against you.
