Legal Question in Criminal Law in New York
Having my record exspunged
Back in 1987 I pleaded no contest to a felony e drug sale, with the understanding after I did my 5 years probabtion I could have it drop to a MISDEMEANOR. Long story short I transfered my probation to Calif. My attorney told me he would do this for me after my probation which I did without any problems. I never persued it until now I am apply for a card dealer permit in Calif. I can not have a felony on my record. My attorney is dead. What can I do? Can I have this dropped or exspunged? Talk about your past haunting you. I sure wish I had taking the a misdemeanor and done the 6 weeks now. Desperate single mon here trying to survive I need help.

You need a local lawyer in NY. Id call your original lawyer and see what he can do.
Re: Having my record exspunged
Congratulations on having passed probation. Well done!
You must go back to the same court where you entered your plea and have it done there.
The first thing you must do is write to the DA office in that place and ask for assistance (tell them your lawyer has passed on). Also write to the court directly. That may be enough.
If you do not hear back in 60 days, then you must hire a lawyer in that area.
If time is important, then hire a lawyer immediately.
The zip code sounds like Syracuse and I am in New York City.
