Legal Question in Criminal Law in New York

record or no record

morning,

i was convicted of criminal possession of stolen property in 5th which was a misdamenor. i was given a (CD) conditional discharge for 1yr. because i had no prior record my 1 year is up. and id like to know what excatly is (CD) and does this mean i have a record on file or does it become sealed after my year on CD is over, if i have a record what would it say about CD or does it even mention it. im in the process of getting a new better job and of course on application it asked if you ever been assested/ convicted. and im not sure if this 5th degree misdamenor will appear or not..

thanks

Re: record or no record

You were convicted of a Class A misdemeanor. The CD (which stand for Conditional Discharge) was part of your sentence. A CD basiaclly means stay out of trouble for 1 year. If someone violates the terms of a CD (by getting arrested again as just one example) the Court can hold a violation of CD hearing and sentence someone to up to 1 year in jail. If someone did a background check on you, it would show you were convicted of a misdemeanor.
