What is the rico law? Someone says that if a felon is around a gun but not in their possession they will still catch the charge. Is this true?

In New York state you can be charged with possession of a firearm under the theory of constructive possession. You do not need to be holding the firearm in order to be charged with possession of a weapon. It may be enough if you exercise control over the area where the firearm was found.
