Legal Question in Criminal Law in New York
Rights of Immunity
My friend is being charged with a felony and for her grand jury testimony against someone else is being advised to sign a waiver to right of immunity for a reduced sentenced. By signing this waiver can her testimony be later used against her to charge her with a crime pertaining to any part of her testimony that implicates she herself knew of the crime or participated in the crime.

Re: Rights of Immunity
by waiving immunity she may be opening herself up to a lot more potential liability that she has now, overall such a request is not made... generally there is a waiver of 180.80 whch is requested, this is rather diffrent... please feel free to contact my office for a free consultation at 212.709.8303
Re: Rights of Immunity
The short answer is maybe. It will depend on exactly what the cooperation agreement says. By waiving immunity your friend may be exposed to additional criminal charges and she should have an attorney review the cooperation agreement and to make sure she understands exactly what the parameters of the plea deal are. Please feel free to contact my office if we may be of any assistance in this matter.
