Legal Question in Criminal Law in New York
robbery
hello, my boyfriend and i were on our way to an amusement park. it was me my friend his friend and him. his friend asked us to take him to his girlfriends house. we dropped him of and came back to get him within 10 minutes. he got in the car and we headed to my house to get my daughter. when we got to my house the police pulled us over and told us that a store got robbed of their bank deposit and that my car was used as a get away. the police found the checks on my boyfriends friend and they found the money on my boyfriend, because his friend gave it to him and told him that, that was his birthday present. mine and my friends charges were dismissed but my boyfriend is still facing charger of 1st degree robbery and posetions of stolen property. he is on parole and has been incarsarated for 11 months waiting for trial. the district atturney has no proff of a weapon and no witness to state that anything was stolen. how is it that the district attorney could still procced with this trial. and is their a good chance that my boyfriend will be convicted. Thank you

You are correct: there are problems with this prosecution.
He should have a court-appointed lawyer working to get this to trial.
He may be in jail for violating the terms of his probation; he was consorting with a criminal!
Lawyers are just like everyone else: we sometimes need to be prodded. It might be helpful for you to make an appointment to see his lawyer and make a once-a-week telephone call after the meeting to get some action.
Once-a-week is not harassment, its just a reasonable interest and may help keep your friend uppermost in the lawyer's mind.
