Legal Question in Criminal Law in New York
robbery charge
I have a long story to tell but not enough room to tell it. My husband was arrested in July of 2005, he spent 8 months in jail, before his sister was able to get up enough money to get a bond and get him out. He has been too every court date on time.Anyway last week he to court and got into an argument with his lawyer because his lawyer couldnt remeber what happened at his last court date. So his lawyer then said Im not going to represent you anymore. SO when my husband went in front of the judge he told him that he needs to find a new lawyer. The judge then said you have till 9 am tomorrow morning to come back with a lawyer. My husband said that is impossible for me to do. The judge then repeated himself as so did my husband. The judge then said your bail has been revoked took him back into custody and put his bail up to $50,000 from $20,000. My question is can he legally do that? No new charges were pressed, and he isnt considered a flight risk. Please help me!!! I also am looking for a lwyer so if anyone is willing to take on a pro-bono case, we really need it. I cant afford a paid lawyer right now and I m scared that legal aide wont be able to get him off these charges. Someone please help me!!!

Generally, the judge may ammend bail for any reasonable condition - it is very difficult to say what happened in your situation as i do not have sufficient facts - as far as the other attorney not knowing what happen at the previous court date, this sounds odd as this is soemthing that could easily be found out with just a few basic questions on the court room, or looking at the court file which is always at the attorneys reach.
I wish you luck in finding a private attorney to handle this matter pro-bono, honestly i do not think this sounds like the type of case most of us would be willing to take on pro-bono - my office would be willing to conisder a reasonable payment plan. Okay, many things are addressed in this small area and, to tell the truth, there is not enough information to give an intelligent answer on any of the issues. I am sure the Judge will be able to articulate a reason as to why the bail status was changed, no matter what anyone else's take on the situation is. I am sure that the legal aid attorney is qualified to address issues surrounding the areas you are inquiring about. I am pretty sure that there is not going to be a stampede of private attorneys looking to accept this case on a pro bono basis. However, obviously there is some ability to raise "some" money since bail or bond was originally made. I suggest you contact local counsel, set up a consultation, explain the situation fully and honestly and try to work out payment.
