Legal Question in Criminal Law in New York
Rule 35
can a rule 35 be filed even thought he has been sentenced and has been serving time for over 5 yrs, release year is 2018 and is labeled a career criminal? there were lots of things that went wrong due to his PD. in for drug charges, crack.

Yes he may still eligible for rule 35 relief. See an attorney immediately to discuss same. It is not an inexpensive proposition however.
