Legal Question in Criminal Law in New York

Sale of Alcohol to Intoxicated Individual

Young man celebrating 21st birthday...drank in several establishments with friends, elevating his BAC to .275....walking home, wandered onto the highway, where he was struck and killed by a hit and run driver. Is there any liability on the part of the establishments that served him?

Re: Sale of Alcohol to Intoxicated Individual

The 'Dram Shop Laws' are designed to create liability to the bars for this very situation. The bars have a legal duty not to send intoxicated customers into the streets. You are welcome to a consultation at no charge at my offices at 42 west 44th st, ny,ny. please call for an appointment first - 646-591-5786.
