Legal Question in Criminal Law in New York
Sale of Alcohol to Intoxicated Individual
Young man celebrating 21st birthday...drank in several establishments with friends, elevating his BAC to .275....walking home, wandered onto the highway, where he was struck and killed by a hit and run driver. Is there any liability on the part of the establishments that served him?

There may be liability if the establishments served him while knowing he was already intoxicated. If you want to discuss a potential wrongful death suit, please call me at 212-622-7180.

The 'Dram Shop Laws' are designed to create liability to the bars for this very situation. The bars have a legal duty not to send intoxicated customers into the streets.
