Legal Question in Criminal Law in New York
Search warrant and arrest
Yesterday, my home was searched via warrant for drugs. Nothing other than a weed pipe and an antique rifle were found and my husband and my innocent mother-in-law were arrested (and still awaiting arraignment). Ultimately, he is charged with a misdemeanor. Neither my husband nor I have EVER sold drugs!! After removing my husband and his mother, I came home to a dump. I admitted that while using marijuana recreationally, there has NEVER been any distribution! They showed me a picture of a strange woman whom we have never seen and said that my husband was inviting her over while I'm at work to sell drugs. They told him that it was I who was selling with this woman behind his back. Completely untrue!! Since then, I have spoken to my husband - he doesn't understand what is happening and why! Neither of us know of this third party in question and we're afraid. Also, the detective called my landlord, lied and said they found crack, cocaine and heroin on the premises, which they did not, neither is my husband being charged with that. Now we have to move! I know that this is either a case of mistaken identity or corruption. Is it possible to fabricate evidence on people who do drugs from time to time? I am seeking counsel desparately!

Re: Search warrant and arrest
You should retain a lawyer for your husband and mother-in-law right away, since the charges could be potentially serious and result in jail time. Please feel free to contact my office if we may be of any assistance.
Re: Search warrant and arrest
It sounds like you both need counsel. Overall, you very well may have some defenses and it may be possible to even end these cases without any criminal record...
However, I would like to discuss this case with you further.
