Legal Question in Criminal Law in New York
i am currently seeking employment as a licensed practical nurse in rochester, ny. in 2004 i was convicted of harassment in the 2nd degree with a 1 year ACD. am i required to answer yes to the question have you ever been convicted of a crime? on an application. i am very confused and have been given alot of different answers.

You are getting different answers because your information is incorrect. If you were given an ACD then there is no conviction. If you were however convicted and given a CD then there is a conviction. You need to find out the disposition of the case. Ultimately, however Harassment 2nd is a violation and not a crime.
Either way you look at it, you were not convicted of a crime so you can answer no without an explanation.
