Legal Question in Criminal Law in New York

Sentence

My child father who is now incarcerated for violating an OOP. I want to know how long will he be behing bar. He have a criminal background of robbery in the 1 and 2degree and substance in the 1 & 2 as well. The charge he faces are penal codes 215.50 and 215.51. How long will he be behind bars or what would the judge sentence look like will there be a plea in this matter if so will it be the max or little time to nothing.

If the 'violation of order of protection' is deemed a parole violation, then he will possibly be required to fulfill his entire sentence. On the other hand, the violation alone may not produce any jail time. the judge may jail him for up to 6 months for violating the order, but that would be unusual for a first time.

The important thing is for you to be involved in the process. You must be heard. You can influence the district attorney.

You can contact the district attorney directly or through a 'victim protection' office. A woman's legal aid organization or legal aid can also assist you.
