Legal Question in Criminal Law in New York

sentence overturn

Hi my husband is currently incarcerated at a NY State Correctional Facility, he has been there for almost 20 yrs. This upcoming August he will be seen by the parole board to see if he is eligible for release. When he was 15 yrs old he was charged with the following crimes and was sentenced to a 8-life bid. My question is, from your experiance what chances does he have of coming home and can he live with me and my minor son? Will he be on the sex offender's list? If so how long and what level from your experiance. Do you handle these types of cases.

After all this time can the life sentence be overturned? Do you think that a court will allow this?

Re: sentence overturn

Your husband's chances before the parole board rely on too many factors to go into on this response. I would be more than happy to discuss this in more detail. Please feel free to email me your contact information so we may discuss in more detail: [email protected].

Re: sentence overturn

It is impossible to answer your first question without a lot more information.

As for whether he would be able to live with you and your child will depend on his parole conditions and his parole officer.

Given his convictions, he will be given a SORA level. It will likely be a level 2 or 3 which means a lifetime on the reports.

New evidence may help overturn a verdict but it won't be easy after all these years.
