Legal Question in Criminal Law in New York

Sentencing Possibilities for Harassment Charge

My friend was charged with harassment. It is his first time offense. What sort of sentencing is usually given to this type of case? Is there any chance that he will have to spend time in jail? Thanks.

Re: Sentencing Possibilities for Harassment Charge

Harassment 2nd degree is a violation, not a crime and is punishable with up to 15 days imprisonment. Harassment 1st degree ia a B misdemeanor and is punishable by up to 90 days imprisonment. For a first offender the DA usually offers a disposition of "Adjourned contemplating dismissal" which means that if the offender does not get into any other violations within usually a 6 month period the charge is dismissed.Absent such an offer, there usually is a fine plus a surcharge for a first offender.
