Legal Question in Criminal Law in New York

shock parole violation

My fiance is in rikers island for a violation of failure to report. we have good mitigating defenses, but the administrative staff wants to send him to willard. We do not want that, we want revoke and restore and outpatient. my fiance is a college attendee, employee at a good firm and is a good citizen, he made a mistake. he was going to turn himself in but unfortunately was caught before so. he is very scared and wants to come home. i on the other hand was sexually assaulted outside of rikers last thursday and need him home. what can we do to help this situation and have the judge look at him as a person and not a statistic

Re: shock parole violation

The first thing you could do is hire a private attorney to handle this matter for you, you will not receive the same level of attention by legal aid...

There will be various factors that come into play, such as has he violtated before, the fact that he waited to rurn himself in and was brought in involuntarily makes it a bit more difficult but not necessarily impossible... all mitigating factors generally are taken into account, but without proper representation he will be exactly this - a statistic.
