Shoplifting
I was caught shoplifting $61 of merchandise. I was not arrested but I have an upcoming court date. Do I need a lawyer? Will I be facing jail time or just a fine? Will this go on my permanent record?

The possible plea-bargains include a violation not a crime but still on a record of the court or an ACD which is a dismissal after a period of good behavior usually 6 months. A lawyer is definitely the way to go as he or she will be better able to obtain the ACD or might even make a motion for an immediate dismissal in the interest of justice. Both of the last two possibilities erase the case from all records.

Having a lawyer with you in court will greatly increase your chances of having your case reduced to a violation or dismissed entirely. You will probably get a violation, which is not a crime, and a fine if it's your first shoplifting charge. If not some counties are starting a program just for shoplifters.
