Legal Question in Criminal Law in New York

Shoplifting Second Offense

Ok the story is that i was caught once for shoplifting, and was charged with petit larceny and then was luckily given an ACD. And had to complete shoplifting class which i did promptly.

Over this weekend i was charge with 13 counts of possesion of stolen property ( Class A misdeameanor ). What happen was that i was at a retail store that caught me shoplifting and then caught me with items from other stores. I now have violated my ACD for

The police then got the retailers from other stores to claim their property and all of them wanted me arrested. So I spent a day in jail and posted bail.

Since i violated my ACD is there any reconsideration for ACD again? or Will i now have to spend time locked up?

Do misdeameanors affect financial aid loans?

Re: Shoplifting Second Offense

There are many issues to discuss regarding your question. Misdemeanor convictions can affect financial aid, dependant on the type of aid. you would be best suited by simply contacting your provider directly and asking such questions.

generally, an ACD is a one time break given to defenants on minor charges... generally, shoplifting does fall into this category... however, the fact that there were so many charges filed subsequent virtually ensures that the DA will seek a criminal conviction, and perhaps not just stop at that...

with regards to the previous ACD the new charges now potentially open that up to be reargued, and potentially a new charge to be added to the count.

If you are able to i would suggest hiring private counsel to assist you with these cases, yo uwould be ebst suited by protecting yoru criminal record and seeing if this matter may be handled in a way that would ensure your record is protected...
