Legal Question in Criminal Law in New York

Shoplifting. Ugh!

This is beyond humiliating. On December 3rd I was arrested and charged with petit larceny for an incident in Sephora (bottom line, I totally did it, it was apart of a huge prank - stupid.) Anyway, I have a court appearance next week, today I recieved a letter from Sephora's lawyers asking for a settlement in the civil case of $350. This is the first time I've ever been in anything that even resembled trouble. The merchandise amounted to $70. I can't afford an attorney right now and I make too much too qualify for a court appointed attorney. I have no idea where to go from here. It seems crazy that I'm going to end up paying Sephora $350, a criminal fine of God knows how much, community service and the torture of being held in a cell for 3 hours the night of the incident. What should I do???? Please Help, I'm panicked.

Don't panic. You made a stupid decision now don't compound it. Be smart. Get a lawyer. If you can't afford a lawyer then you can't afford a lawyer. Tell the court, and the judge will appoint one. If you are working, however, you might not qualify, as you note, then call around. Not every lawyer costs a zillion bucks. But have a professional deal with this, and chill--it's not the end of the world.

You may be facing up to a year in jail for a charge of petit larceny, along with a potential criminal record. You really should have a lawyer handle the criminal case. The judge can appoint an attorney for you, but if you do not qualify you should retain one on your own.

You have a great deal at stake. You are facing a misdemeanor charge with a possible jail term,possible probation,possible fine and community service.
