Legal Question in Criminal Law in New York
I have a situation that I may need legal help for.
My father was arrested for child molestation in New York State. One of the children was my daughter. I guess out of pennance, he assigned me as power of attourney and wrote a letter stating that I could use his money any way I see fit. He is now due to be released from prison and there is no money in his accounts.
Can he file charges of embezzelment or anything like that? Our life was turned upsidedown and needed these funds to pretty much start a new life in a new location.
Please help.
David

Not a simple answer. It mostly depends on the wording of the power of attorney, how the accounts were set up and how thw monwy was used. It is a question which has a criminal, civil and forensic accounting aspect to it.
