Legal Question in Criminal Law in New York
my son was arrested last night
My son who is 17 was at a party last night. Some kids crashed the party and started throwing punches one boy had his jaw broken and a bloody head. My son was jumped by these kids from behind and punched in the head. police were called and kids were asked to leave ,there were about 70 kids at party. there were no parents home and alcohol was served.Everyone scattered and got into different cars. the car my son left in was pulled over. him and the driver were ripped out of the car and placed on a curb.The officer than asked the party crasher if these boys threw a brick thru his windshield. They said yes. the police then stopped more cars and arrested 6 more kids three of which weren't at the party. These boys didn't do it. They had no idea what they were charged with. They were taken in read their rights and kept them until detectives arrived 5 hours later.They were not allowed phone calls I was a wreck all night until 11am when the police finally let my son call me. They were processed and I was told to meet them at the Cenral Islip courthouse where he would be arraigned.since that couldn't be arraigned they were told to go back to the police station and be held till next morning a detective wound up getting them out on $100 bail

Obviously you know your son needs a lawyer. He is charged with at least a misdemeanor and the charges could be upgraded to a felony depending on the facts. It seems he is also entitled to a possible false arrest suit and a malicious prosecution at least as to the police and the complainants. You should seek out a lawyer who handles both Criminal and Civil rights law suits. It seems your son may also have a suit against the child and family that threw the party. You need to speak to a lawyer pronto!
