Legal Question in Criminal Law in New York

Hello, I have a son who attends Highschool. I believe he is being wrongfully accused of stealing a desktop from school. The dean contacted me. He stated that my son was on video walking backwards with something under his jacket. He pulled my son out of class and questioned him, told him that he had him on video but never showed him the video. I have not seen the video either. I think we should have seen the video before he handed it over the police to investigate. He said that he would contact me to make an appointment to view the video. He also so stated that my son was a suspect for stealing a laptop. I don't believe this. No one contacted about it.

If criminal charges are forthcoming you can subpoena the video. You should also make a written request and a FOIL demand, for the information, f he does not set up an appt. to view the video. Your son should also not speak to police, school or any investigators without the presence of a lawyer. This should also be communicated to all involved in written form.
