Legal Question in Criminal Law in New York
Our son, while on felony probation for a previous unrelated charge, was arrested and plead quilty to a felony dui. He received a plea sentence of one year in the county jail for the dui. Upon release, will he be required to resume probation for the other offense?

He would be required to complete his probationary sentence. However, a new conviction violates his conditions of probations and could result in a violation of probation and a sentence of incarceration instead of a continuation of probation.
