Legal Question in Criminal Law in New York

Spongement of misdeaminor

Back in 2003 i was sentence in nassau county court for theft. I paid a restitution and fines. I plea guilty of unauthorized use of a computer. Now my question is:is it possible to sponge those misdearminors since that was my first and last breached with the law? And i also i move to another state should i petition the court down here or should i go to ny for that?

Re: Spongement of misdeaminor

Before you waste a lot of money, you must realize NY does not have an expungment statute. Anyone who tells you differently is lying to you or is sadly mistaken. I chair a committee of the NYS Bar Association that is working on getting such a statute but we are no where near one yet.

There are other things you can do which may help you maintain jobs and other opportunities, but they fall way short of an expungement. If you would like to speak about these opportunities, you may contact me by following the links below.

Best wishes

You can have an attorney check the status and file for the expungement. This area of law is our specialty, however, we would need some more information before making a complete and proper determination. You are welcome to contact us for a free consultation.
