Legal Question in Criminal Law in New York
statute of limitations for wrongful death suit
My sister was murdered in NY 40 years ago by a 16 yr old boy who served approximately 10 yrs in jail for the crime. We believe that we have finally located him and would like to sue him for wrongful death. Is this a possibility, or is there a statute of limitations?

My guess is that the statute of limitations has run, but I would check with a civil lawyer in NY. Another thing to consider is assuming you could sue, what would you get? If he has no assets, there is no recovery.
