Statutory Rape
If a man Is 23 and the girl is 17 is it legal in nys to have sexual relations. also if she wanted to move in with him could she?

Statutory rape is a status offense. The fact that she is under 18 is all that counts. She cannot legally consent.
Moving in is a possibility, if she is not engaging in intimate relations with an over-18 male. There is an issue of 'coorupting a minor' and also, why is she not living with parents and going to school.? But it is not a sex-crime and a felony like statutory rape.
