Legal Question in Criminal Law in New York
statutory rape in ny
what is the law in new york regarding statutory rape? I've seen many conflicting answers, some which say both people have to be 18 or over for sex to be consentual and others that say 17 and over is consentual. also, what defines sex? is it just intercourse and oral sex or is kissing and/or massaging included?

Re: statutory rape in ny
The age of consent in Ny is NOT 18, it is 17. Sex under the statute involves penetration (vaginal or anal) or oral sex of any kind.
Furthermore, there generlaly has to be a 5 year age difference between the two people.
