Legal Question in Criminal Law in New York
What should be my next step?
Got a summons lastnight in violation of NYC code 1-03 A3 for being on the boardwalk after closing time. To be honest I didnt know the boardwalk had a closing time. It's not like they're signs going down the boardwalk telling you what time it closes. Long story short, my cousin and I enjoying the breeze, eating and talking when two officers pulled up and informed us that the boardwalk is closed. We got up to leave and one officer says "no it doesn't work like that give us your id's", so we did. After running ours names and not finding anything, we both got a summons. Mind you there were other people on the boardwalk as well, that did not get a summons. Of course I got pissed and told the officer, "I hope you give everyone else a summons because we're not the only ones out here". The officer also put my address on my cousin's summons (he does not live or stays at that address) because the id he had does not have an address on it, he does not live here he's only visiting.

During the summer months, the police issue several hundred of these boardwalk summonses ('park after dark'); however, the selective issuance of these summonses is unfair and in some cases discriminatory.
Most importantly, handle your summons before considering any other legal action. If you need a free consultation and fee quote, please contact me.
