Legal Question in Criminal Law in New York

Stolen Check?

Recently a payment of $8,000for a job my company did was sent to our old company that is now out of business. The previous owner cashed the check. Sent a letter to the payee and told them they overpaid and sent a refund check of $1,800.

He is doing this to get back at us for leaving and starting our own. The old company went under.

He had nothing to do with the job . We have a DBA using the part of the old company name so he could technically cash the check.

Is this grand larceny? Does the payee need to go to the police? Is there any justification he can possibly make on this cashing of our check?

There are a lot of people who could get this idiot arrested. The payee, for larceny, the new company for fraud and it could even potentially be a federal case.

I hope the old owner saved some money for his legal fees.
