Legal Question in Criminal Law in New York
I submitted the following question: In New York State after a defendant has been convicted, can he gain access to the grand jury testimony of the prosecutor's witnesses. I received 2 answers.
One from Pierre who stated that it cannot be done. The second was from the Sussman legal firm.
They stated that all that had to be done was to " move the court to copy".
I also called the DA's office in Ulster county, and they said not even the defense attorney could have access to the transcripts. Who is right?

Grand jury minutes are sealed and are not available to the defense because an appeal is not predicated on the information presented in the grand jury but at trial to the petite jury.
