Legal Question in Criminal Law in New York
supena... what is the proper protocol?
Ok so I was a witness to an event took
place recently. The police took me in for
questioning but did not arrest or finger
print me. I did not sign or write a written
statement but I did tell my side of the
story while an officer and a detective took
notes. They then released me and
promised they would not tell the
defendant what I said. They lied to me
because I court they said my full name
while the defendant and everyone we
know was there. They wanted me to
appear in court but that would put me in
danger. I was never handed a supena. The
cops never came to my house looking for
me. But this morning they called my house
and told my grandpa I need to come in. He
said I wasn't there and has not seen me.
Can I not go? Can they arrest me if I don't
if I wasn't handed a supena or does the
call count? What do I do?

So long as you are not under arrest you have a constitutional
