Legal Question in Criminal Law in New York

Teenager arrested

My teenage son, 16, was arrested by town police, handcuffed, brought to the station, questioned & charged with criminal trespass. He was never read his miranda rights, and we showed up @ the station prior to his questioning and were forbidden contact with him & not given the opportunity to contact a lawyer. 2 hours latter he was permitted to walk out with a desk appearance ticket. There were no visible signs saying no trespassing - and it is questionable about exactly where he & his friends were pulled over. The one police officer we spoke with said they were pulled over on a public road, after being observed on privat property. What should we do?

It really is not as serious as you perceive. I do not know where the incident took place, but the fact that your son was issued an appearance ticket and that this is his first arrest leads me to believe this will be resolved via plea-bargaining without jail time and very likely without your son getting a criminal record.
