Legal Question in Criminal Law in New York
Time limit from arrest to indictment for dismissal
If a person is arrested with a felony complaint in ny and for some reason is never sent to grand jury and therefore is never indicted on those . How long before the charges can be dismissed 90 days 180 days ?? I don't know isn't there speedy trail laws ??

Section 30.30 of the C.P.L. proscribes a 6 month period within which the prosecution must be ready for trial on a felony case . However , there are various exclusions for which the time periods will not be charged to them such as "consent" adjournments agreed to by defense counsel to negotiate a possible disposition.
