You can absolutely be charged with petit larceny under New York State law. In fact, my office sees plenty of similar cases from Century 21 throughout the year. And you probably will receive a letter from an attorney representing H&M seeking a dollar amount equal to about 2-3x the value of the merchandise in question. You or your parents should consult an experienced criminal defense attorney on how to proceed if you are contacted by the store's attorneys or law enforcement.

You can read more about the 'shoplifting trap' at http://www.petit-larceny.com and contact me through the website.

Good luck!
