Legal Question in Criminal Law in New York

Trespassing

I was walking to the coner store when I saw my friend. I went over to him. He was siting on the steps of this building. I' am their talking to him and before you know it, three cops come and check us from head to toe. I have nothing on me and I have never got in troble with the law, but this cops takes me in and charged with 2nd degree trespassing. I have an interview with HSBC banking which I worked hard to get, and now I want to know should I be worry. Would this come up on the background check and I wont get the job?

You have only been arrested and not convicted,therefore you are presumed innocent. That being said you must disclose all the relevant details of that arrest to your prospective employer,they will know about the incident from a background check. Being honest is always best in these circumstances. A background check of your current criminal record will show an arrest and pending charges. You should have a qualified attorney to represent you on the charges and to assist you to deal with the possible ramifications of the background check. Since you are only going on the initial interview the background check would probably not occur for a period of time.
