unlawful possession or marijuana

I got pulled over and got a ticket for unlawful possession of marijuana and have a court date this week. I was wondering what the fine or penalty is going to be? I have been arrested before but my records are closed.

I have read your responses to this question. I agree mostly with the responses received. However, since you have a prior record for what? was not disclosed, I would recommend that you go to court represented by counsel.

You can probably avoid any fine. The police/DA will need a lab report for the marijuana. Its unlikely that they requested one. I assume the charge is a violation, which means they will have 15 days from the court date to get a lab report so you should demand one -- its unlikely they will get it. In the alternative, if you have no public record, you should ask for a marijuana ACD. The case gets adjourned for 1 year and then dismissed and sealed.

This charge is a violation with a maximum fine of $100 and $80 costs. There is a possibility of 15 days in jail but that is very unlikely. It is not a criminal offense and so does not go on your record. Pay up and move on.
