Legal Question in Criminal Law in New York
Vacating a criminal charge
I have a 3rd degree felony charge from New York for the attempted sale of a controlled substance. I was convicted 17 years ago. Can the charges be vacated or expunged? If so, do I have to be in the U.S.?

Re: Vacating a criminal charge
It is possible to make a motion to set aside the judgment of conviction under CPL 440. These motions are difficult to win and I would need to know a lot more about your case before I could advise you.
If you would like to discuss the possibility of clearing the conviction, please give me a call.
